Sunan al-Darimi – سنن الدارمي – Hadith #1632

أَخْبَرَنَا سَعِيدُ بْنُ عَامِرٍ ، عَنْ شُعْبَةَ ، عَنْ قَتَادَةَ ، عَنْ الْحَسَنِ ، عَنْ سَمُرَةَ بْنِ جُنْدُبٍ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ، وَمَنْ جَدَعَهُ، جَدَعْنَاهُ ".
قَالَ : ثُمَّ نَسِيَ الْحَسَنُ هَذَا الْحَدِيثَ، وَكَانَ يَقُولُ : لَا يُقْتَلُ حُرٌّ بِعَبْدٍ
Sa'id bin Amir informed us, on the authority of Shu'bah, on the authority of Qatada, on the authority of Al-Hasan, on the authority of Samurah bin Jundub: that the Messenger of God, may God bless him and grant him peace, And he said: “Whoever kills his servant, We will kill him, and whoever kills him, We will kill him.”
He said: Then Al-Hasan forgot this hadith, and he used to say: A free person should not be killed for a slave.
