Sunan al-Darimi – سنن الدارمي – Hadith #2150

حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ ، عَنْ عِيسَى بْنِ يُونُسَ ، عَنْ إِسْمَاعِيل ، قَالَ : ذَكَرْنَا عِنْدَ حَكِيمِ بْنِ جَابِر : أَنَّ ابْنَ مَسْعُودٍ قَالَ فِي أَخَوَاتٍ لِأَبٍ وَأُمٍّ وَإِخْوَةٍ وَأَخَوَاتٍ لِأَبٍ : أَنَّهُ كَانَ يُعْطِي لِلْأَخَوَاتِ مِنْ الْأَبِ وَالْأُمِّ الثُّلُثَيْنِ، وَمَا بَقِيَ فَلِلذُّكُورِ دُونَ الْإِنَاثِ، فَقَالَ حَكِيمٌ : قَالَ زَيْدُ بْنُ ثَابِتٍ :" هَذَا مِنْ عَمَلِ الْجَاهِلِيَّةِ أَنْ يَرِثَ الرِّجَالُ دُونَ النِّسَاءِ إِنَّ إِخْوَتَهُنَّ قَدْ رُدُّوا عَلَيْهِنَّ "
Saeed bin Al-Mughirah told us, on the authority of Issa bin Yunus, on the authority of Ismail, he said: We mentioned, according to Hakim bin Jabir: that Ibn Masoud said in Paternal and maternal sisters, paternal brothers and sisters: He used to give two-thirds to the paternal and maternal sisters, and what was left was given to the males. And not the females, so a wise man said: Zaid bin Thabit said: “This is the practice of the pre-Islamic era, for men to inherit without women, since their brothers have been assigned to them.” "
