أَخْبَرَنَا مُحَمَّدُ بْنُ حُمَيْدٍ ، حَدَّثَنَا هَارُونُ بْنُ الْمُغِيرَةِ ، عَنْ عَنْبَسَةَ بْنِ سَعِيدٍ ، عَنْ خَالِدِ بْنِ زَيْدٍ الْأَنْصَارِيِّ ، عَنْ عَقَّارِ بْنِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، عَنْ أَبِيهِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، قَالَ : نَشَدَ عُمَرُ النَّاسَ : أَسَمِعَ مِنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَحَدٌ مِنْكُمْ فِي الْجَنِينِ؟ فَقَامَ الْمُغِيرَةُ بْنُ شُعْبَةَ، فَقَالَ : قَضَى فِيهِ عَبْدًا أَوْ أَمَةً، فَنَشَدَ النَّاسَ أَيْضًا : فَقَامَ الْمَقْضِيُّ لَهُ ، فَقَالَ : " قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِي بِهِ عَبْدًا أَوْ أَمَةً " فَنَشَدَ النَّاسَ أَيْضًا : فَقَامَ الْمَقْضِيُّ عَلَيْهِ ، فَقَالَ : قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " عَلَيَّ غُرَّةً عَبْدًا أَوْ أَمَةً "، فَقُلْتُ : أَتَقْضِي عَلَيَّ فِيهِ فِيمَا لَا أَكَلَ، وَلَا شَرِبَ، وَلَا اسْتَهَلَّ، وَلَا نَطَقَ؟ أَنْ تُطِلَّهُ فَهُوَ أَحَقُّ مَا يُطَلُّ " فَهَمَّ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَيْهِ بِشَيْءٍ مَعَهُ "، فَقَالَ :" أَشِعْرٌ؟ "، فَقَالَ عُمَرُ : لَوْلَا مَا بَلَغَنِي مِنْ قَضَاءِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَجَعَلْتُهُ دِيَةً بَيْنَ دِيَتَيْنِ

Muhammad ibn Humayd informed us, Harun ibn al-Mughirah informed us, on the authority of Anbasa ibn Sa`id, on the authority of Khalid ibn Zayd al-Ansari, on the authority of Aqar bin Al-Mughirah bin Shu’bah, on the authority of his father, Al-Mughirah bin Shu’bah, said: Omar asked the people: I hear from the Prophet, may God bless him and grant him peace. Which of you is in the fetus? Then Al-Mughirah bin Shu’bah stood up and said: He judged a male or female slave, so he called on the people as well: Then the one who was judged stood up and said: “The Prophet, may God’s prayers and peace be upon him, has decided.” “Ali, may God’s prayers and peace be upon him, pronounced a verdict on me, by surprise.” Or a female nation.” So I said: “Will you judge me in it for something that I neither eat, nor drink, nor pronounce, nor speak?” If you let him go, he is most deserving of what he has to let go.” Then the Prophet, may God’s prayers and peace be upon him, approached him about something with him, and he said: “Do I feel?” Then Omar said: If it had not been for him, he would not have informed me. From the decree of the Prophet, may God bless him and grant him peace, I will make it a blood money between two blood moneys.
