أَخْبَرَنَا أَبُو الْمُغِيرَةِ ، حَدَّثَنَا الْأَوْزَاعِيُّ ، حَدَّثَنِي يَحْيَى ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" لَا تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ، وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ، وَإِذْنُهَا الصُّمُوتُ ".
أَخْبَرَنَا وَهْبُ بْنُ جَرِيرٍ ، حَدَّثَنَا هِشَامٌ ، عَنْ يَحْيَى ، عَنْ أَبِي سَلَمَةَ : أَنَّ أَبَا هُرَيْرَةَ حَدَّثَهُ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، بِهَذَا الْحَدِيثِ

Abu Al-Mughirah told us, Al-Awza’i told us, Yahya told me, on the authority of Abu Salamah, on the authority of Abu Hurairah, he said: The Messenger of God, may God bless him and grant him peace, said May God bless him and grant him peace: “Do not marry a virgin until she is asked for permission, and her permission is silence.”
Wahb bin Jarir told us, Hisham told us, on the authority of Yahya, on the authority of Abu Salamah: that Abu Hurairah told him, on the authority of the Messenger of God, may God bless him and grant him peace. Peace be upon him, with this hadith

أَخْبَرَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا يُونُسُ بْنُ أَبِي إِسْحَاق ، حَدَّثَنِي أَبُو بُرْدَةَ بْنُ أَبِي مُوسَى ، عَنْ أَبِي مُوسَى ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا، فَإِنْ سَكَتَتْ، فَقَدْ أَذِنَتْ، وَإِنْ أَبَتْ لَمْ تُكْرَهْ "

Abu Nu`aym told us, Yunus bin Abi Ishaq told us, Abu Burdah bin Abi Musa told me, on the authority of Abu Musa, he said: The Messenger of God said: May God’s prayers and peace be upon him: “The orphan is to be appointed to herself, and if she remains silent, then she is given permission, and if she refuses, she is not forced to do so.”

حَدَّثَنَا أَبُو عَاصِمٍ ، عَنْ ابْنِ جُرَيْجٍ ، عَنْ سُلَيْمَانَ بْنِ مُوسَى ، عَنْ الزُّهْرِيِّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا، فَنِكَاحُهَا بَاطِلٌ، فَنِكَاحُهَا بَاطِلٌ، فَنِكَاحُهَا بَاطِلٌ، فَإِنْ اشْتَجَرُوا، قَالَ أَبُو عَاصِمٍ، وَقَالَ مَرَّةً : فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ، فَإِنْ أَصَابَهَا، فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا ".
قَالَ أَبُو عَاصِمٍ : أَمْلَاهُ عَلَيَّ سَنَةَ سِتٍّ وَأَرْبَعِينَ وَمِائَةٍ

Abu Asim told us, on the authority of Ibn Jurayj, on the authority of Suleiman bin Musa, on the authority of Al-Zuhri, on the authority of Urwa, on the authority of Aisha, on the authority of the Prophet, may God bless him and grant him peace. And peace be upon him, he said: “Any woman who is married without the permission of her guardian, her marriage is invalid. Abu Asim said, and he once said: If they quarrel, then the sultan is the guardian of the one who has no guardian, and if he harms her, then she gets the dowry for what he has taken from her private parts.”
Abu Asim said: He dictated it to me in the year one hundred and forty-six.

أَخْبَرَنَا مَالِكُ بْنُ إِسْمَاعِيل ، حَدَّثَنَا إِسْرَائِيلُ ، عَنْ أَبِي إِسْحَاق ، عَنْ أَبِي بُرْدَةَ ، عَنْ أَبِيهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" لَا نِكَاحَ إِلَّا بِوَلِيٍّ "

أَخْبَرَنَا أَبُو عَاصِمٍ ، عَنْ إِبْرَاهِيمَ بْنِ عُمَرَ بْنِ كَيْسَانَ ، عَنْ أَبِيهِ ، عَنْ وَهْبِ بْنِ أَبِي مُغِيثٍ ، حَدَّثَتْنِي أَسْمَاءُ بِنْتُ أَبِي بَكْرٍ ، عَنْ عَائِشَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" أَنْكِحُوا الصَّالِحِينَ وَالصَّالِحَاتِ ".
قَالَ أَبُو مُحَمَّد : وَسَقَطَ عَلَيَّ مِنَ الْحَدِيثِ " فَمَا تَبِعَهُمْ بَعْدُ فَحَسَنٌ "

Abu Asim told us, on the authority of Ibrahim bin Omar bin Kaysan, on the authority of his father, on the authority of Wahb bin Abi Mughith, Asmaa, my father’s daughter, told me Bakr, on the authority of Aisha, on the authority of the Prophet, may God bless him and grant him peace, who said: “Marry the righteous men and the righteous women.”
Abu Muhammad said: And the hadith that came across to me was: “And whatever followed them after that was good.”

حَدَّثَنَا خَالِدُ بْنُ مَخْلَدٍ ، حَدَّثَنَا مَالِكٌ ، عَنْ نَافِع ، عَنِ ابْنِ عُمَرَ ، قَالَ : "نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الشِّغَارِ ".
قَالَ مَالِكٌ : وَالشِّغَارُ : أَنْ يُزَوِّجَ الرَّجُلُ الْآخَرَ ابْنَتَهُ، عَلَى أَنْ يُزَوِّجَهُ الْآخَرُ ابْنَتَهُ بِغَيْرِ صَدَاقٍ، قِيلَ لِأَبِي مُحَمَّدٍ : تَرَى بَيْنَهُمَا نِكَاحًا؟.
قَالَ : لَا يُعْجِبُنِي

Khaled ibn Mukhlid told us, Malik told us, on the authority of Nafi’, on the authority of Ibn Umar, he said: “The Messenger of God, may God bless him and grant him peace, forbade al-Shughar.”
Malik said: Al-Shughar: for a man to marry his daughter to another man, provided that the other man marries his daughter to him without dowry. It was said to Abu Muhammad: Do you think? Is there a marriage between them?

حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الْمَجِيدِ ، حَدَّثَنَا مَالِكٌ ، عَنْ أَبِي الزِّنَادِ ، عَنْ الْأَعْرَجِ ، عَنْ أَبِي هُرَيْرَةَ : " أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَنَهَى أَنْ يُجْمَعَ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَالْمَرْأَةِ وَخَالَتِهَا "

Ubayd Allah ibn Abdul Majeed narrated to us, Malik narrated to us, on the authority of Abu al-Zinad, on the authority of al-Araj, on the authority of Abu Hurairah: “The Messenger of God, may God bless him and grant him peace “On him and grant him permission to bring together a woman and her paternal aunt and a woman and her paternal aunt.”

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، حَدَّثَنَا دَاوُدُ يَعْنِي ابْنَ أَبِي هِنْدٍ ، حَدَّثَنَا عَامِرٌ ، حَدَّثَنَا أَبُو هُرَيْرَةَ : " أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَنَهَى أَنْ تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا، وَالْعَمَّةُ عَلَى ابْنَةِ أَخِيهَا، أَوْ الْمَرْأَةُ عَلَى خَالَتِهَا، أَوْ الْخَالَةُ عَلَى بِنْتِ أُخْتِهَا، وَلَا تُنْكَحُ الصُّغْرَى عَلَى الْكُبْرَى، وَلَا الْكُبْرَى عَلَى الصُّغْرَى "

Yazid bin Harun told us, Dawud told us, meaning Ibn Abi Hind, Amer told us, Abu Hurairah told us: “The Messenger of God, may God bless him and grant him peace And he made it permissible for a woman to be married to her paternal aunt, and a paternal aunt to her brother’s daughter, or a woman to her paternal aunt, or a maternal aunt to her daughter. Her sister, and the younger should not be married to the eldest, nor should the eldest be married to the younger.”

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أَنْبَأَنَا مُحَمَّدُ بْنُ عَمْرٍو ، عَنْ أَبِي سَلَمَةَ ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ : أَنَّهَا حَدَّثَتْهُ وَكَتَبَهُ مِنْهَا كِتَابًا أَنَّهَا كَانَتْ تَحْتَ رَجُلٍ مِنْ قُرَيْشٍ، مِنْ بَنِي مَخْزُومٍ، فَطَلَّقَهَا الْبَتَّةَ، فَأَرْسَلَتْ إِلَى أَهْلِهِ تَبْتَغِي مِنْهُمُ النَّفَقَةَ، فَقَالُوا : لَيْسَ لَكِ نَفَقَةٌ، فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ :" لَيْسَ لَكِ نَفَقَةٌ، وَعَلَيْكِ الْعِدَّةُ، وَانْتَقِلِي إِلَى بَيْتِ أُمِّ شَرِيكٍ ، وَلَا تُفَوِّتِينَا بِنَفْسِكِ "، ثُمَّ قَالَ : " إِنَّ أُمَّ شَرِيكٍ امْرَأَةٌ يَدْخُلُ إِلَيْهَا إِخْوَانُهَا مِنَ الْمُهَاجِرِينَ، وَلَكِنِ انْتَقِلِي إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى، إِنْ وَضَعْتِ ثِيَابَكِ لَمْ يَرَ شَيْئًا وَلَا تُفَوِّتِينَا بِنَفْسِكِ "، فَانْطَلَقَتْ إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ فَلَمَّا حَلَّتْ، ذَكَرَتْ أَنَّ مُعَاوِيَةَ، وَأَبَا جَهْمٍ خَطَبَاهَا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَمَّا مُعَاوِيَةُ، فَرَجُلٌ لَا مَالَ لَهُ، وَأَمَّا أَبُو جَهْمٍ، فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ، فَأَيْنَ أَنْتِ مِنْ أُسَامَةَ؟ " فَكَأَنَّ أَهْلَهَا كَرِهُوا ذَلِكَ، فَقَالَتْ : وَاللَّهِ لَا أَنْكِحُ إِلَّا الَّذِي قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَنَكَحَتْ أُسَامَةَ.
قَالَ مُحَمَّدُ بْنُ عَمْرٍو : قَالَ مُحَمَّدُ بْنُ إِبْرَاهِيمَ : يَا فَاطِمَةُ ، اتَّقِي اللَّهَ، فَقَدْ عَلِمْتِ فِي أَيِّ شَيْءٍ كَانَ هَذَا، قَالَ : وَقَالَ ابْنُ عَبَّاسٍ : قَالَ اللَّهُ تَعَالَى : # يَأَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ وَأَحْصُوا الْعِدَّةَ وَاتَّقُوا اللَّهَ رَبَّكُمْ لا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلا يَخْرُجْنَ إِلا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ سورة الطلاق آية 1 # وَالْفَاحِشَةُ أَنْ تَبْذُوَ عَلَى أَهْلِهَا، فَإِذَا فَعَلَتْ ذَلِكَ، فَقَدْ حَلَّ لَهُمْ أَنْ يُخْرِجُوهَا

Yazid bin Harun informed us, Muhammad bin Amr informed us, on the authority of Abu Salamah, on the authority of Fatima bint Qais: that she narrated it to him and he wrote it. This reached the Messenger of God, may God bless him and grant him peace, and he said: You are not entitled to maintenance, and you have to prepare, and go to the house of my mother. partner, and do not escape us with your soul.” Then he said: “Sharek’s mother is a woman whose brothers among the immigrants would come to her, but go to the house of Ibn Umm Maktum, for he is a blind man. If you put on your clothes, he will not see anything, and do not let us go by yourself.” So she set off for the house of Umm Maktum’s son, and when she arrived, She mentioned that Muawiyah and Abu Jahm had proposed to her, and the Messenger of God, may God bless him and grant him peace, said: “As for Muawiyah, he is a man who has no money. Abu Jahm, so he does not put his staff down, so where do you stand with Osama? “It was as if her family disliked that, so she said: By God, I will not marry anyone except what the Messenger of God, may God bless him and grant him peace, said, so she married Usama.
Muhammad bin Amr said: Muhammad bin Ibrahim said: O Fatima, fear God, for you know what this was about. He said: And Ibn Abbas said: God Almighty said: #O Prophet, when you divorce women, divorce them after their waiting period, and count the waiting period, and fear Allah, your Lord. Do not expel them from their homes and do not go out unless they commit a clear indecency. Surat Al-Talaq, Verse 1 #And an indecency is that she commits indecency against her family.
