أَخْبَرَنَا سَعِيدُ بْنُ عَامِرٍ ، عَنْ شُعْبَةَ ، عَنْ قَتَادَةَ ، عَنْ الْحَسَنِ ، عَنْ سَمُرَةَ بْنِ جُنْدُبٍ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ :" مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ، وَمَنْ جَدَعَهُ، جَدَعْنَاهُ ".
قَالَ : ثُمَّ نَسِيَ الْحَسَنُ هَذَا الْحَدِيثَ، وَكَانَ يَقُولُ : لَا يُقْتَلُ حُرٌّ بِعَبْدٍ

Sa'id bin Amir informed us, on the authority of Shu'bah, on the authority of Qatada, on the authority of Al-Hasan, on the authority of Samurah bin Jundub: that the Messenger of God, may God bless him and grant him peace, And he said: “Whoever kills his servant, We will kill him, and whoever kills him, We will kill him.”
He said: Then Al-Hasan forgot this hadith, and he used to say: A free person should not be killed for a slave.

أَخْبَرَنَا جَعْفَرُ بْنُ عَونٍ ، عَنْ إِسْمَاعِيل بْنِ مُسْلِمٍ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" لَا تُقَامُ الْحُدُودُ فِي الْمَسَاجِدِ، وَلَا يُقَادُ بِالْوَلَدِ الْوَالِدُ "

Ja'far bin Aoun told us, on the authority of Ismail bin Muslim, on the authority of Amr bin Dinar, on the authority of Tawus, on the authority of Ibn Abbas, he said: The Prophet said, May God bless him and grant him peace: “Punishments are not to be performed in mosques, and the child is not to be led by the father.”

أَخْبَرَنَا إِسْحَاق ، أَخْبَرَنَا جَرِيرٌ ، عَنْ مُطَرِّفٍ ، عَنْ الشَّعْبِيِّ ، عَنْ أَبِي جُحَيْفَةَ ، قَالَ : قُلْتُ لِعَلِيٍّ : يَا أَمِيرَ الْمُؤْمِنِينَ، هَلْ عَلِمْتَ شَيْئًا مِنَ الْوَحْيِ إِلَّا مَا فِي كِتَابِ اللَّهِ تَعَالَى؟.
قَالَ : " لَا وَالَّذِي فَلَقَ الْحَبَّةَ وَبَرَأَ النَّسَمَةَ،مَا أَعْلَمُهُ إِلَّا فَهْمًا يُعْطِيهِ اللَّهُ الرَّجُلَ فِي الْقُرْآنِ، وَمَا فِي الصَّحِيفَةِ ".
قُلْتُ : وَمَا فِي الصَّحِيفَةِ؟.
قَالَ : " الْعَقْلُ، وَفِكَاكُ الْأَسِيرِ، وَلَا يُقْتَلُ مُسْلِمٌ بِمُشْرِكٍ "

Ishaq told us, Jarir told us, on the authority of Mutarrif, on the authority of Ash-Sha’bi, on the authority of Abu Juhayfa, he said: I said to Ali: O Commander of the Faithful, did you know? Any revelation except what is in the Book of God Almighty?
He said: “No, by the one who split the grain and created the breath, I only know the understanding that God gives a man in the Qur’an and what is on the scroll.”
I said: What is in the newspaper?
He said: “The mind, and the redemption of the prisoner, and a Muslim should not be killed by a polytheist.”

أَخْبَرَنَا عَفَّانُ ، حَدَّثَنَا هَمَّامٌ ، حَدَّثَنَا قَتَادَةُ ، عَنْ أَنَسٍ : أَنَّ جَارِيَةً رُضَّ رَأْسُهَا بَيْنَ حَجَرَيْنِ، فَقِيلَ لَهَا : مَنْ فَعَلَ بِكِ هَذَا أَفُلَانٌ، أَفُلَانٌ؟ حَتَّى سُمِّيَ الْيَهُودِيُّ، فَأَوْمَأَتْ بِرَأْسِهَا، فَبُعِثَ إِلَيْهِ فَجِيءَ بِهِ، فَاعْتَرَفَ،" فَأَمَرَ بِهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَرُضَّ رَأْسُهُ بَيْنَ حَجَرَيْنِ "

Affan told us, Hammam told us, Qatada told us, on the authority of Anas: A slave girl had her head smashed between two stones, and it was said to her: Who did this to you? This is so-and-so, so-and-so? Until the Jew was named, and she nodded her head, and he was sent to him and he was brought, and he acknowledged it.” Then the Prophet, may God bless him and grant him peace, ordered him to do so, and he was obligated to do so. His head is between two stones.”

أَخْبَرَنَا الْحَكَمُ بْنُ مُوسَى ، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ ، عَنْ سُلَيْمَانَ بْنِ دَاوُدَ ، حَدَّثَنِي الزُّهْرِيُّ ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَى أَهْلِ الْيَمَنِ وَكَانَ فِي كِتَابِهِ :" أَنَّ الرَّجُلَ يُقْتَلُ بِالْمَرْأَةِ "

Al-Hakam bin Musa told us, Yahya bin Hamza told us, on the authority of Sulayman bin Dawud, Al-Zuhri told me, on the authority of Abu Bakr bin Muhammad bin Amr bin Hazm, on the authority of his father, on the authority of his grandfather: The Messenger of God, may God bless him and grant him peace, wrote to the people of Yemen and it was in his letter: The man will be killed with the woman.”

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الرَّقَاشِيُّ ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ ، حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاق ، حَدَّثَنَا بُشَيْرُ بْنُ يَسَارٍ ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ ، قَالَ : خَرَجَ عَبْدُ اللَّهِ بْنُ سَهْلِ بْنِ أَبي حَثْمَةَ أَحَدُ بَنِي حَارِثَةَ إِلَى خَيْبَرَ مَعَ نَفَرٍ مِنْ قَوْمِهِ يُرِيدُونَ الْمِيرَةَ بِخَيْبَرَ ، قَالَ : فَعُدِيَ عَلَى عَبْدِ اللَّهِ، فَقُتِلَ : فَتُلَّتْ عُنُقُهُ حَتَّى نُخَعَ ثُمَّ طُرِحَ فِي مَنْهَلٍ مِنْ مَنَاهِلِ خَيْبَرَ ، فَاسْتُصْرِخَ عَلَيْهِ أَصْحَابُهُ، فَاسْتَخْرَجُوهُ فَغَيَّبُوهُ، ثُمَّ قَدِمُوا عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَدِينَةَ ، فَتَقَدَّمَ أَخُوهُ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَكَانَ ذَا قِدَمٍ مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَابْنَا عَمِّهِ مَعَهُ : حُوَيِّصَةُ بْنُ مَسْعُودٍ وَمُحَيِّصَةُ، فَتَكَلَّمَ عَبْدُ الرَّحْمَنِ وَكَانَ أَحْدَثَهُمْ سِنًّا، وَهُوَ صَاحِبُ الدَّمِ وَذَا قَدَمٍ فِي الْقَوْمِ فَلَمَّا تَكَلَّمَ، قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْكُبْرَ الْكُبْرَ ".
قَالَ : فَاسْتَأْخَرَ فَتَكَلَّمَ حُوَيِّصَةُ وَمُحَيِّصَةُ، ثُمَّ هُوَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" تُسَمُّونَ قَاتِلَكُمْ، ثُمَّ تَحْلِفُونَ عَلَيْهِ خَمْسِينَ يَمِينًا، ثُمَّ نُسَلِّمُهُ إِلَيْكُمْ ".
قَالُوا : يَا رَسُولَ اللَّهِ، مَا كُنَّا لِنَحْلِفَ عَلَى مَا لَا نَعْلَمُ، مَا نَدْرِي مَنْ قَتَلَهُ، إِلَّا أَنَّ اليَهُودَ عَدُوُّنَا، وَبَيْنَ أَظْهُرِهِمْ قُتِلَ.
قَالَ : " فَيَحْلِفُونَ لَكُمْ بِاللَّهِ إِنَّهُمْ لَبُرَاءُ مِنْ دَمِ صَاحِبِكُمْ، ثُمَّ يَبْرَءُونَ مِنْهُ ".
قَالُوا : مَا كُنَّا لِنَقْبَلَ أَيْمَانَ يَهُودَ، مَا فِيهِمْ أَكْثَرُ مِنْ أَنْ يَحْلِفُوا عَلَى إِثْمٍ.
قَالَ : فَوَدَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ بِمِائَةِ نَاقَةٍ

Muhammad bin Abdullah Al-Raqqashi narrated to us, Yazid bin Zurayi narrated to us, Muhammad bin Ishaq narrated to us, Bashir bin Yasar narrated to us, on the authority of Sahl Bin Abi Hathamah, he said: Abdullah bin Sahl bin Abi Hathamah, one of the Banu Haritha, went to Khaybar with a group of his people wanting to receive food. In Khaybar, he said: Abdullah was attacked and killed. His neck was cut until he was soaked, then he was thrown into one of the waterholes of Khaybar, and he was shouted at. His companions, so they took him out and hid him, then they came to the Messenger of God, may God bless him and grant him peace, Medina, and his brother Abd al-Rahman bin Sahl came forward. Dhul-Rahman was traveling with the Messenger of God, may God bless him and grant him peace, and his two cousins ​​were with him: Huwayysa bin Masoud and Muhayysa, so Abd al-Rahman spoke. He was the youngest of them in age, and he was of noble blood and distinguished among the people. When he spoke, the Messenger of God, may God bless him and grant him peace, said: “Arrogance is arrogance.”
He said: Then he delayed, and Huwaysa and Muhaysa spoke, then he, and the Messenger of God, may God bless him and grant him peace, said: “You name your killer, then you swear We will give him fifty oaths, then we will hand him over to you.”
They said: O Messenger of God, we would not swear about what we do not know. We do not know who killed him, except that the Jews are our enemy, and he was killed between them.
He said: “Then they swear to you by God that they are innocent of your companion’s blood, then they are innocent of him.”
They said: We would not accept the oaths of the Jews, for there is nothing more in them than swearing a sinful oath.
He said: The Messenger of God, may God bless him and grant him peace, paid tribute to him with one hundred she-camels.

أَخْبَرَنَا الْحَكَمُ بْنُ مُوسَى ، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ ، عَنْ سُلَيْمَانَ بْنِ دَاوُدَ ، حَدَّثَنِي الزُّهْرِيُّ ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ : أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَى أَهْلِ الْيَمَنِ ، وَكَانَ فِي كِتَابِهِ :" أَنَّ مَنْ اعْتَبَطَ مُؤْمِنًا قَتْلًا عَنْ بَيِّنَةٍ فَإِنَّهُ قَوَدُ يَديِهِ إِلَّا أَنْ يَرْضَى أَوْلِيَاءُ الْمَقْتُولِ ".
قَالَ أَبُو مُحَمَّدٍ : اعْتَبَطَ : قَتَلَ مِنْ غَيْرِ عِلَّةٍ

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاق ، عَنْ الْحَارِثِ بْنِ فُضَيْلٍ ، عَنْ سُفْيَانَ بْنِ أَبِي الْعَوْجَاءِ السُّلَمِيِّ ، عَنْ أَبِي شُرَيْحٍ الْخُزَاعِيِّ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ :" مَنْ أُصِيبَ بِدَمٍ أَوْ خَبْلٍ وَالْخَبْلُ : الْجُرْحُ فَهُوَ بِالْخِيَارِ بَيْنَ إِحْدَى ثَلَاثٍ : فَإِنْ أَرَادَ الرَّابِعَةَ، فَخُذُوا عَلَى يَدَيْهِ : بَيْنَ أَنْ يَقْتَصَّ أَوْ يَعْفُوَ، أَوْ يَأْخُذَ الْعَقْلَ فَإِنْ أَخَذَ مِنْ ذَلِكَ شَيْئًا ثُمَّ عَدَا بَعْدَ ذَلِكَ، فَلَهُ النَّارُ خَالِدًا فِيهَا مُخَلَّدًا "

Yazid bin Harun informed us, Muhammad bin Ishaq informed us, on the authority of Al-Harith bin Fudayl, on the authority of Sufyan bin Abi Al-Awja Al-Sulami, on the authority of Abu Shurayh Al-Khuza’i said: I heard the Messenger of God, may God bless him and grant him peace, saying: “Whoever is afflicted with blood or dementia, and the dementor is the wound, it is With a choice between one of three: If he wants the fourth, then take it at his hands: Between retaliating or pardoning, or taking the mind, if he takes from That was one thing, then something else after that, so for him is the Fire to abide therein forever.”
