حَدَّثَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ ، حَدَّثَنَا أَبُو أُسَامَةَ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ ، قَالَ :" يُحْرِزُ الْوَلَاءَ مَنْ يُحْرِزُ الْمِيرَاثَ "

Abdullah bin Saeed told us, Abu Usama told us, on the authority of Hisham, on the authority of his father, he said: “Loyalty is achieved by the one who achieves inheritance.”

حَدَّثَنَا سَعِيدُ بْنُ عَامِرٍ ، عَنْ ابْنِ عَوْنٍ ، عَنْ مُحَمَّدٍ ، قَالَ : مَاتَ مَوْلًى لِعُمَرَ، فَسَأَلَ ابْنُ عُمَرَ زَيْدَ بْنَ ثَابِتٍ ، فَقَالَ : هَلْ لِبَنَاتِ عُمَرَ مِنْ مِيرَاثِهِ شَيْءٌ؟ قَالَ :" مَا أَرَى لَهُنَّ شَيْئًا، وَإِنْ شِئْتَ أَنْ تُعْطِيَهُنَّ، أَعْطَيْتَهُنَّ "

Saeed bin Amir told us, on the authority of Ibn Aoun, on the authority of Muhammad, he said: A freed slave of Omar died, so Ibn Omar asked Zayd bin Thabit, and he said: Are there any daughters? Omar has any of his inheritance? He said: “I don’t see anything for them, but if you want to give it to them, you can give it to them.”

حَدَّثَنَا أَبُو النُّعْمَانِ ، حَدَّثَنَا وُهَيْبٌ ، حَدَّثَنَا يُونُسُ ، عَنْ الْحَسَنِ ، أَنَّهُ كَانَ يَقُولُ فِي امْرَأَةٍ مَاتَتْ وَتَرَكَتْ مَوْلًى، قَالَ :" الْوَلَاءُ لِبَنِيهَا، فَإِذَا مَاتُوا، رَجَعَ إِلَى عَصَبَتِهَا "

Abu Al-Nu’man told us, Wahib told us, Yunus told us, on the authority of Al-Hasan, that he used to say about a woman who died and left behind a master. He said: Loyalty is to its sons, and if they die, it returns to its clan.”

حَدَّثَنَا عُبَيْدُ اللَّهِ ، عَنْ إِسْرَائِيلَ ، عَنْ مَنْصُورٍ ، قَالَ : سَأَلْتُ إِبْرَاهِيمَ عَنْ رَجُلٍ كَاتَبَ عَبْدًا لَهُ، ثُمَّ مَاتَ وَتَرَكَ وَلَدًا رِجَالًا وَنِسَاءً، قَالَ :" لِلذُّكُورِ دُونَ الْإِنَاثِ "

Ubayd Allah told us, on the authority of Israel, on the authority of Mansour, who said: I asked Abraham about a man who wrote a slave to him, then he died and left behind a number of sons. And women. He said: “For males, not females.”

أَخْبَرَنَا عَمْرُو بْنُ عَوْنٍ ، عَنْ خَالِدِ بْنِ عَبْدِ اللَّهِ ، عَنْ خَالِدٍ الْحَذَّاءِ ، عَنْ أَبِي قِلَابَةَ فِي امْرَأَةٍ مَاتَتْ، وَتَرَكَتْ بَنِيهَا، فَوَرِثُوهَا مَالًا وَمَوَالِيَ، قَالَ :" يَرْجِعُ الْوَلَاءُ إِلَى عَصَبَةِ الْمَرْأَةِ "

حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى ، عن مُعَاذٌ ، عَنْ أَشْعَثَ ، عَنْ الْحَسَنِ ، قَالَ :" لَا تَرِثُ النِّسَاءُ مِنْ الْوَلَاءِ إِلَّا مَا أَعْتَقْنَ، أَوْ أَعْتَقَ مَنْ أَعْتَقْنَ، إِلَّا الْمُلَاعَنَةُ، فَإِنَّهَا تَرِثُ مَنْ أَعْتَقَ ابْنُهَا، وَالَّذِي انْتَفَى مِنْهُ أَبُوهُ "

Muhammad bin Issa told us, on the authority of Muadh, on the authority of Ash’ath, on the authority of Al-Hasan, who said: “Women do not inherit from the lineage except what they have emancipated, or who has emancipated whomever.” emancipated, except for the cursed woman, for she inherits from the one who emancipates her son, from whom his father is absent.”
