حَدَّثَنَا هَارُونُ بْنُ مُعَاوِيَةَ ، عَنْ أَبِي سُفْيَانَ ، عَنْ مَعْمَرٍ ، عَنْ قَتَادَةَ ، قَالَ :" إِذَا ابْتَاعَ الْمُكَاتَبَانِ أَحَدُهُمَا الْآخَرَ : هَذَا هَذَا مِنْ سَيِّدِهِ، وَهَذَا هَذَا مِنْ سَيِّدِهِ، فَالْبَيْعُ لِلْأَوَّلِ.
وَيَقُولُ أَهْلُ الْمَدِينَةِ : الْوَلَاءُ لِسَيِّدِ الْبَائِعِ، وَيَقُولُونَ : إِنَّمَا ابْتَاعَ هَذَا مَا عَلَى الْمُكَاتَبِ، فَالْوَلَاءُ لِلسَّيِّدِ

Harun bin Muawiyah told us, on the authority of Abu Sufyan, on the authority of Muammar, on the authority of Qatada, who said: “If two agents buy one another: This one is from his master, and this one is from his master, so the sale is to the first.
The people of the city say: Loyalty is to the master of the seller, and they say: This man bought what was on the counter, so loyalty is to the master.

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ صَالِحٍ ، حَدَّثَنِي اللَّيْثُ ، حَدَّثَنِي يُونُسُ ، عَنْ ابْنِ شِهَابٍ : وَسَأَلْنَاهُ عَنْ السِّقْطِ، فَقَالَ :" لَا يُصَلَّى عَلَيْهِ، وَلَا يُصَلَّى عَلَى مَوْلُودٍ حَتَّى يَسْتَهِلَّ صَارِخًا "

Abdullah bin Salih told us, Al-Layth told me, Yunus told me, on the authority of Ibn Shihab: We asked him about a miscarriage, and he said: “He should not be prayed over, nor A prayer is prayed over a newborn until it begins screaming.”

حَدَّثَنَا أَبُو النُّعْمَانِ ، حَدَّثَنَا أَبُو عَوَانَةَ ، عَنْ مُغِيرَةَ ، عَنْ إِبْرَاهِيمَ ، قَالَ :" لَا يُوَرَّثُ الْمَوْلُودُ حَتَّى يَسْتَهِلَّ، وَلَا يُصَلَّى عَلَيْهِ حَتَّى يَسْتَهِلَّ، فَإِذَا اسْتَهَلَّ، صُلِّيَ عَلَيْهِ وَوُرِّثَ، وَكُمِّلَتْ الدِّيَةُ "

Abu Al-Numan told us, Abu Awanah told us, on the authority of Mughirah, on the authority of Ibrahim, who said: “The newborn is not inherited until he begins, and does not pray.” upon him until he begins, and when he begins, the funeral prayer is performed over him and he inherits, and the blood money is completed.”

حَدَّثَنَا يَحْيَى بْنُ حَسَّانَ ، حَدَّثَنَا يَحْيَى هُوَ ابْنُ حَمْزَةَ ، عَنْ زَيْدِ بْنِ وَاقِدٍ ، عَنْ مَكْحُولٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" لَا يَرِثُ الْمَوْلُودُ حَتَّى يَسْتَهِلَّ صَارِخًا، وَإِنْ وَقَعَ حَيًّا "

Yahya bin Hassan told us, Yahya, he is the son of Hamza, told us, on the authority of Zayd bin Waqid, on the authority of Makhoul, he said: The Messenger of God, may God’s prayers and peace be upon him, said May God bless him and grant him peace: “The newborn does not inherit until he starts screaming, even if he falls alive.”

حَدَّثَنَا مَالِكُ بْنُ إِسْمَاعِيل ، حَدَّثَنَا إِسْرَائِيلُ ، عَنْ سِمَاكٍ ، عَنْ عِكْرِمَةَ ، عَنْ ابْنِ عَبَّاسٍ ، قَالَ :" لَيْسَ مِنْ مَوْلُودٍ إِلَّا يَسْتَهِلُّ، وَاسْتِهْلَالُهُ بِعَصْرِ الشَّيْطَانُ بَطْنَهُ، فَيَصِيحُ، إِلَّا عِيسَى ابْنَ مَرْيَمَ "

Malik bin Ismail told us, Israel told us, on the authority of Simmak, on the authority of Ikrimah, on the authority of Ibn Abbas, he said: “There is no newborn except He begins, and his initiation is with Satan squeezing his stomach, and he shouts, except for Jesus, son of Mary.”

حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا شَرِيكٌ ، عَنْ أَبِي إِسْحَاق ، عَنْ عَطَاءٍ ، عَنْ ابْنِ عَبَّاسٍ ، قَالَ :" إِذَا اسْتَهَلَّ الصَّبِيُّ، وَرِثَ وَوُرِثَ وَصُلِّيَ عَلَيْهِ "

Abu Nu`aym told us, Sharik told us, on the authority of Abu Ishaq, on the authority of Ata’, on the authority of Ibn Abbas, who said: “If a boy begins his inheritance, he inherits and is inherited.” And may blessings be upon him.”

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أَنْبَأَنَا الْأَشْعَثُ ، عَنْ أَبِي الزُّبَيْرِ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، قَالَ :" إِذَا اسْتَهَلَّ الصَّبِيُّ، وُرِّثَ وَصُلِّيَ عَلَيْهِ "

Yazid bin Harun told us, Al-Ash’ath informed us, on the authority of Abu Al-Zubayr, on the authority of Jabir bin Abdullah, who said: “If a boy begins, he inherits And may blessings be upon him.”

حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا الْمَسْعُودِيُّ ، عَنْ الْقَاسِمِ ، قَالَ : " أَعْتَقَ رَجُلٌ غُلَامًا سَائِبَةً، فَأَتَى عَبْدَ اللَّهِ ، وَقَالَ : إِنِّي أَعْتَقْتُ غُلَامًا لِي سَائِبَةً، وَهَذِهِ تَرِكَتُهُ، قَالَ : هِيَ لَكَ، قَالَ :لَا حَاجَةَ لِي فِيهَا، قَالَ : فَضَعْهَا، فَإِنَّ هَهُنَا وَارِثًا كَثِيرًا "

Abu Nu`aym told us, Al-Masoudi told us, on the authority of Al-Qasim, he said: “A man freed a stray boy, so Abdullah came and said: I freed a I have a slave who was left alone, and this is his inheritance.
