حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا أَبُو دَاوُدَ ، عَنْ شُعْبَةَ ، قَالَ : أَخْبَرَنِي مَنْصُورٌ ، عَنْ إِبْرَاهِيمَ ، وَالشَّعْبِيِّ ، قَالَا :" لَا بَأْسَ بِبَيْعِ وَلَاءِ السَّائِبَةِ وَهِبَتِهِ "

Abu Bakr bin Abi Shaybah told us, Abu Dawud told us, on the authority of Shu’bah, he said: Mansour told me, on the authority of Ibrahim, and Al-Shu’bi, They said: “There is no harm in selling Al-Saibeh’s walaa and giving it away.”

حَدَّثَنَا أَبُو سَعِيدِ بْنُ عَمْرٍو ، عَنْ أَبِي بَكْرِ بْنِ أَبِي مَرْيَمَ ، عَنْ ضَمْرَةَ ، وَرَاشِدِ بْنِ سَعْدٍ ، وَغَيْرِهِمَا، قَالُوا فِيمَنْ أُعْتِقَ سَائِبَةً :" إِنَّ وَلَاءَهُ لِمَنْ أَعْتَقَهُ، إِنَّمَا سَيَّبَهُ مِنْ الرِّقِّ، وَلَمْ يُسَيِّبْهُ مِنْ الْوَلَاءِ "

Abu Sa`id bin Amr told us, on the authority of Abu Bakr bin Abi Maryam, on the authority of Damra, Rashid bin Saad, and others, they said about who was freed “His loyalty is to the one who freed him. He only freed him from slavery, and did not free him from loyalty.”

حَدَّثَنَا يَعْلَى ، حَدَّثَنَا إِسْمَاعِيل ، عَنْ عَامِرٍ ، عَنْ مَسْرُوقٍ : فِي رَجُلٍ مَاتَ وَلَمْ يَكُنْ لَهُ مَوْلَى عَتَاقَةٍ، قَالَ :" مَالُهُ حَيْثُ أَوْصَى بِهِ، فَإِنْ لَمْ يَكُنْ أَوْصَى، فَهُوَ فِي بَيْتِ الْمَالِ "

حَدَّثَنَا أَبُو حَاتِمٍ الْبَصْرِيُّ هُوَ رَوْحُ بْنُ أَسْلَمَ ، حَدَّثَنَا بِشْرُ بْنُ الْمُفَضَّلِ ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاق ، عَنْ أَبِيهِ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَمْرٍو ، قَالَ : " مَاتَ مَوْلًى عَلَى عَهْدِ عُثْمَانَ وَلَيْسَ لَهُ وَالٍ،فَأَمَرَ بِمَالِهِ، فَأُدْخِلَ بَيْتَ الْمَالِ "

حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا زَكَرِيَّا ، قَالَ : سُئِلَ عَامِرٍ عَنْ الْمَمْلُوكِ يُعْتَقُ سَائِبَةً لِمَنْ وَلَاؤُهُ؟ قَالَ :" لِلَّذِي أَعْتَقَهُ "

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ ، أَنْبَأَنَا سُلَيْمَانُ ، عَنْ أَبِي عُثْمَانَ ، قَالَ : قَالَ عُمَرُ :" الصَّدَقَةُ وَالسَّائِبَةُ لِيَوْمِهِمَا، أَوْ لِوَقْتِهِمَا "

قَالَ عَبْدُ اللَّهِ بْنُ يَزِيدَ : قَالَ شُعْبَةُ : لَمْ يَسْمَعْ هَذَا مِنْ سَلَمَةَ أَحَدٌ غَيْرِي

Abu Nu'aym and Abdullah bin Yazid told us, saying: Shu'bah told us, on the authority of Salamah bin Kuhayl, on the authority of Abu Amr Al-Shaybani, he said: Abdullah said: “Al-Sa’i’bah puts his money wherever he wants.”

حَدَّثَنَا إِسْمَاعِيل بْنُ أَبَانَ ، عَنْ مُوسَى بْنِ مُحَمَّدٍ الْأَنْصَارِيِّ ، قَالَ : حَدَّثَنِي الْحَارِثُ بْنُ حَصِيرَةَ ، عَنْ زَيْدِ بْنِ وَهْبٍ ، عَنْ عَلِيٍّ : أَنَّهُ قَالَ فِي وَلَدِ الزِّنَا لِأَوْلِيَاءِ أُمِّهِ :" خُذُوا ابْنَكُمْ تَرِثُونَهُ وَتَعْقِلُونَهُ، وَلَا يَرِثُكُمْ "

حَدَّثَنَا مَرْوَانُ بْنُ مُحَمَّدٍ ، حَدَّثَنَا الْهَيْثَمُ بْنُ حُمَيْدٍ ، عَنْ الْعَلَاءِ بْنِ الْحَارِثِ ، حَدَّثَنِي عَمْرُو بْنُ شُعَيْبٍ : أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :" قَضَى بِمِيرَاثِ ابْنِ الْمُلَاعَنَةِ لِأُمِّهِ كُلِّهِ، لِمَا لَقِيَتْ فِيهِ مِنْ الْعَنَاءِ "

Marwan bin Muhammad narrated to us, Al-Haytham bin Humaid narrated to us, on the authority of Al-Alaa bin Al-Harith, Amr bin Shuaib narrated to me: That the Prophet, may God’s prayers and peace be upon him He said: “He ruled that the entire inheritance of the son of Al-Mala’ana should go to his mother, because of the hardship she had suffered from him.”
