حَدَّثَنَا الْمُعَلَّى بْنُ أَسَدٍ ، حَدَّثَنَا وُهَيْبٌ ، عَنْ دَاوُدَ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ : أَنَّهُ كَانَ" لَا يُوَرِّثُ الْأَسِيرَ "

Al-Mu'alla ibn Asad narrated to us, Wahib narrated to us, on the authority of Dawud, on the authority of Sa'id ibn Al-Musayyab: That he "did not give inheritance to a prisoner."

حَدَّثَنَا مُحَمَّدٌ ، قَالَ : حَدَّثَنَا سُفْيَانُ ، حَدَّثَنِي مَنْ سَمِعَ إِبْرَاهِيمَ ، يَقُولُ :" يُوَرَّثُ الْأَسِيرُ "

Muhammad narrated to us, he said: Sufyan narrated to us, someone who heard Abraham narrated to me, saying: “The prisoner will be inherited.”

أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ ، حَدَّثَنَا سُفْيَانُ ، عَنْ دَاوُدَ ، عَنْ الشَّعْبِيِّ ، عَنْ شُرَيْحٍ ، قَالَ :" يُوَرَّثُ الْأَسِيرُ إِذَا كَانَ فِي أَيْدِي الْعَدُوِّ "

Muhammad ibn Yusuf told us, Sufyan told us, on the authority of Dawud, on the authority of Al-Sha’bi, on the authority of Shuraih, who said: “The prisoner is inherited if he is in the hands of the enemy.”

حَدَّثَنَا مُحَمَّدُ بْنُ الْفَضْلِ ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ ، حَدَّثَنِي مَعْمَرٌ ، عَنْ إِسْحَاق بْنِ رَاشِدٍ ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي الْأَسِيرِ يُوصِي، قَالَ :" أُجيزُ لَهُ وَصِيَّتَهُ مَا دَامَ عَلَى دِينِهِ لَمْ يَتَغَيَّرْ عَنْ دِينِهِ "

Muhammad bin Al-Fadl told us, Abdullah bin Al-Mubarak told us, Muammar told me, on the authority of Ishaq bin Rashid, on the authority of Omar bin Abdul Aziz Regarding the prisoner making a will, he said: “His will is permitted as long as he adheres to his religion and has not changed his religion.”

أَخْبَرَنَا يَحْيَى بْنُ حَسَّانَ ، حَدَّثَنَا ابْنُ أَبِي الزِّنَادِ ، عَنْ أَبِيهِ ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي امْرَأَةِ الْأَسِيرِ : " أَنَّهَاتَرِثُهُ وَيَرِثُهَا "

Yahya bin Hassan told us, Ibn Abi Al-Zanad told us, on the authority of his father, on the authority of Omar bin Abdul Aziz regarding the prisoner’s wife: “ She inherits from him and he inherits from her.”

حَدَّثَنَا حَجَّاجٌ ، حَدَّثَنَا حَمَّادٌ ، عَنْ سُفْيَانَ الثَّوْرِيِّ ، عَنْ رَجُلٍ ، عَنْ الشَّعْبِيِّ : أَنَّ عَلِيًّا ، وَابْنَ مَسْعُودٍ ، قَالَا فِي الْمَجُوسِ :" إِذَا أَسْلَمُوا، يَرِثُونَ مِنْ الْقَرَابَتَيْنِ جَمِيعًا "

Hajjaj told us, Hammad told us, on the authority of Sufyan al-Thawri, on the authority of a man, on the authority of al-Sha’bi: that Ali and Ibn Masoud said about the Magi: “If “They converted to Islam, inheriting from both relatives.”

حَدَّثَنَا حَجَّاجُ بْنُ مِنْهَالٍ ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ ، عَنْ حَمَّادِ بْنِ أَبِي سُلَيْمَانَ ، قَالَ :" يَرِثُ مِنْ الْجَانِبِ الَّذِي يَصْلُحُ، وَلَا يَرِثُ مِنْ الْجَانِبِ الَّذِي لَا يَصْلُحُ "

Hajjaj bin Minhal told us, Hammad bin Salamah told us, on the authority of Hammad bin Abi Sulaiman, he said: “The side who is fit will inherit, but he will not inherit.” From the side that is not good.”

أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى ، حَدَّثَنَا عَبْدُ الْأَعْلَى ، عَنْ مَعْمَرٍ ، عَنْ الزُّهْرِيِّ ، قَالَ :" إِذَا اجْتَمَعَ نَسَبَانِ، وُرِّثَ بِأَكْبَرِهِمَا، يَعْنِي الْمَجُوسَ "

Muhammad bin Issa told us, Abdul Ala told us, on the authority of Muammar, on the authority of Al-Zuhri, he said: “If two lineages come together, the eldest of them inherits, meaning the Magi"

أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ ، عَنْ سُفْيَانَ ، عَنْ لَيْثٍ ، عَنْ طَاوُسٍ ، عَنْ ابْنِ عَبَّاسٍ ، قَالَ :" لَا يَرِثُ الْقَاتِلُ "

Muhammad bin Yusuf told us, on the authority of Sufyan, on the authority of Laith, on the authority of Tawus, on the authority of Ibn Abbas, who said: “The murderer does not inherit.”

حَدَّثَنَا زَكَرِيَّا بْنُ عَدِيٍّ ، حَدَّثَنَا أَبُو بَكْرٍ ، عَنْ مُطَرِّفٍ ، عَنْ الشَّعْبِيِّ ، قَالَ : قَالَ عُمَرُ :" لَا يَرِثُ قَاتِلٌ خَطَأً، وَلَا عَمْدًا "

Zakaria bin Adi narrated to us, Abu Bakr narrated to us, on the authority of Mutarrif, on the authority of Al-Shabi, who said: Omar said: “No one who kills by mistake or intentionally inherits.”
