Sunan al-Darimi – سنن الدارمي – Hadith #2452

حَدَّثَنَا أَبُو نُعَيْمٍ ، حَدَّثَنَا الْمَسْعُودِيُّ ، عَنْ أَبِي عَوْنٍ ، عَنْ الْقَاسِمِ : " أَنَّ رَجُلًا اسْتَأْذَنَ وَرَثَتَهُ أَنْ يُوصِيَ بِأَكْثَرَ مِنَ الثُّلُثِ، فَأَذِنُوا لَهُ، ثُمَّ رَجَعُوا فِيهِ بَعْدَ مَا مَاتَ، فَسُئِلَ عَبْدُ اللَّهِ عَنْ ذَلِكَ، فَقَالَ :هَذَا التَّكَرُّهُ لَا يَجُوزُ "
Abu Nu`aym told us, Al-Masoudi told us, on the authority of Abu Aoun, on the authority of Al-Qasim: “A man asked his heirs for permission to bequeath more than a third. So they gave him permission, then they returned to him after he died, and Abdullah was asked about that, and he said: This reckless behavior is not permissible.
