أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ ، حَدَّثَنَا الْوَلِيدُ ، عَنْ الْأَوْزَاعِيِّ ، عَنْ يَحْيَى ، قَالَ :" إِذَا اتَّهَمَ الْقَاضِي الْوَصِيَّ لَمْ يَعْزِلْهُ، وَلَكِنْ يُوَكِّلُ مَعَهُ غَيْرَهُ "وَهُوَ رَأْيُ الْأَوْزَاعِيِّ

Muhammad bin Al-Mubarak told us, Al-Walid told us, on the authority of Al-Awza’i, on the authority of Yahya, he said: “If the judge accuses the guardian, he does not remove him. But he appoints someone else with him.” This is the opinion of Al-Awza’i.
